A postal worker who has made claims of alleged voter fraud in Pennsylvania is being questioned over the veracity of those assertions, which have been cited by Republican lawmakers as the basis for an investigation. Richard Hopkins, a mail carrier from Erie, Pa., accused his boss of instructing employees to pick up and bring him ballots that were received after Election Day. Hopkins said he overheard his boss discussing backdating postmarks to make the ballots appear as though they had been collected by Nov. 3, instead of Nov. 4 or after.
On Monday, Hopkins is said to have signed an affidavit recanting those claims, which appeared to be confirmed in a tweet by Democrats on the House Oversight Committee.
The Washington Post, which cited three officials briefed on the investigation, also said Hopkins allegedly admitted to U.S. Postal Service investigators that claims of widespread voting irregularities were fabricated.

・・・・Still, enough voters wanted change. Mr. Biden maneuvered successfully to make the election a referendum on the president’s personality and his handling of Covid. For months Mr. Trump was content to fight on that turf, trying only fitfully to contrast his agenda with his challenger’s.
Mr. Biden led Wednesday in Wisconsin by 20,540 votes, Pennsylvania by 49,064, Michigan by 146,123, Arizona by 12,614, Nevada by 36,870 and Georgia by 14,108.
To win, Mr. Trump must prove systemic fraud, with illegal votes in the tens of thousands. There is no evidence of that so far. Unless some emerges quickly, the president’s chances in court will decline precipitously when states start certifying results, as Georgia will on Nov. 20, followed by Pennsylvania and Michigan on Nov. 23, Arizona on Nov. 30, and Wisconsin and Nevada on Dec. 1.
By seating one candidate’s electors, these certifications will raise the legal bar to overturn state results and make it even more difficult for Mr. Trump to prevail before the Electoral College meets Dec. 14.
U.S. politics remains polarized and venomous. Closing out this election will be a hard but necessary step toward restoring some unity and political equilibrium. Associate Presiding Civil Judge Daniel Kiley on Tuesday granted Snell & Wilmer’s request to withdraw as counsel of record for the Republican National Committee.

The wave of quixotic lawsuits flying out of Trump’s legal team is stretching the boundaries of anything remotely resembling a coherent and evidence-based approach to litigation. In the mere eight days since Election Day, the Trump campaign has filed at least 10 different lawsuits in at least five different states (Michigan, Pennsylvania, Arizona, Georgia, and Nevada). Some of these are run-of-the-mill lawsuits fighting over minor issues, but several directly allege fraud, and a few include documentation claiming to prove the existence of that fraud.
Rule 3.1 of the American Bar Association’s Model Rules of Professional Conduct?upon which most state bars rely at least in part?stipulates that a lawyer shall not bring an action unless a basis exists in law and fact for doing so. This rule implies that lawyers must do due diligence to inform themselves of the facts of the case and reasonably determine that a good-faith argument can be made in defense of the client’s legal claim. Rule 11(b) of the Federal Rules of Civil Procedure?many of which are designed to serve as “gatekeepers” against frivolous lawsuits?requires lawyers to ensure that their arguments are not frivolous, and that factual contentions either have or are reasonably likely to have evidentiary support. Recognizing how close you can get to the line before you topple over it is something that each of the members of the Trump campaign’s outside legal team should be carefully considering these days.
